Bayern Munich and Ajax Amsterdam are still scheduled to open the Raila Odinga International Stadium at Talanta Sports City in Nairobi on Tuesday, 5 January 2027. No court order stopping that game was found in the searches checked for this article on Saturday, 31 October 2026.
That distinction matters, because the pressure on the fixture is real, loud and growing — but it has so far taken a different form from a court case. Kenyans have written directly to the clubs, signed petitions asking them to withdraw, and one activist has warned that he may go to court. None of that, on the evidence found, is the same as activists already being in court to stop the game, with a filing, a hearing date and orders sought. If a filing exists and has not yet been reported in the sources checked, this article will be corrected when its case number, court and pleaded grounds can be verified from the filing or from reputable court reporting.
What has actually happened, in order, is this.
On Wednesday, 28 October 2026, President William Ruto announced, in a recorded address made while he was in Moscow for the Russia-Africa Economic and Humanitarian Forum, that Bayern Munich and Ajax would play the ceremonial opening match at the 60,000-seat stadium, formerly Talanta Stadium, at Jamhuri Grounds along Ngong Road. Both clubs then confirmed the fixture. Bayern described it as "a special match to kick off the new year" and said it would travel to Nairobi on 5 January 2027 to face Ajax as part of the grand opening of the new national stadium. Ajax said it was proud to face Bayern in the opening match. Tickets are scheduled to go on sale on 5 November 2026 through talantasportscity.com. No kick-off time or ticket prices were confirmed in the reports checked.
The backlash began the same day. On 28 October, Mwabili Mwagodi, widely known on X as Jomba, said he had emailed Bayern Munich and Ajax Amsterdam shareholders and shared screenshots of what he said were the emails. TUKO reported on 29 October that Mwagodi's email made personal claims against the Kenyan government and President Ruto, referred to the death of Bridgit Njoki Wainaina and an alleged abduction, and warned the clubs that the match could face protests inside the stadium. TUKO was explicit that those allegations were Mwagodi's personal claims and had not been independently verified or proven in a court of law. Campus Pulse repeats that caution here: the claims in the emails are not findings, and this article does not adopt them.
Mwagodi was not alone. Harrison Mumia, president of the Atheists in Kenya Society, said he had written to Bayern asking the club to reconsider until what he called grave human rights concerns around abductions and enforced disappearances received meaningful attention. Lawyer Ndegwa Njiru separately asked publicly who would meet the full cost of flying in both teams, their staff, officials and entourages, including flights, accommodation, security and local logistics. A Change.org petition published on 28 October, titled "Bayern Munich and Ajax: Withdraw from Kenya's Stadium Inauguration", urges the clubs to withdraw and publish any agreements on fees, funding sources and public subsidies, and urges the government to publish the stadium's procurement, construction and financing records and the full budget and funding sources for the inaugural match. A second Change.org petition, "Demand accountability for the Raila Odinga Stadium", asks Parliament to demand transparency, calls for a historic Kenyan derby to be the first football match in the inauguration programme ahead of the European fixture subject to existing contracts, and states expressly: "We are not alleging wrongdoing, nor are we rejecting international partnerships."
The closest step toward court is a warning, not a filing found. On 29 October, activist and presidential aspirant Boniface Mwangi, in a lengthy post on Instagram reported by K24 Digital on 30 October, questioned the decision to invite the two European clubs, argued the money should support local footballers, and said he had instructed his lawyer to file a Freedom of Information request seeking details of the full cost of the proposed exhibition match. K24 reported that Mwangi warned he would consider taking legal action if the government proceeded with what he described as unnecessary public expenditure. No filed case, case number, court, respondent or order sought by Mwangi in relation to this match was found in the searches checked. An FOI request and a warning that legal action may be considered are not a court case, and must not be reported as one.
The government has pushed back against the email and petition campaign. Foreign Affairs Principal Secretary Korir Singoei urged Kenyans to stop sending emails and petitions to Bayern and Ajax, saying they should be patriotic and stop damaging the country's image on security and governance, according to a report on 31 October. That report also said some emails sent to the clubs contained alarming claims about killings, Ebola threats and attacks on players. Campus Pulse has not seen those emails and does not repeat their claims as fact; they are reported here only as the subject of the Principal Secretary's response, as reported.
There IS a real court case connected to Talanta — but it is not about the Bayern-Ajax game. In Petition E041 of 2026 before the Environment and Land Court, the Law Society of Kenya, the Green Belt Movement and JustAct challenged the Kenya Urban Roads Authority's decision to excise part of Ngong Road Forest for a proposed road linking Talanta Sports City to the Bomas International Conference Centre, and works at an eco-lodge site in the forest's Sanctuary Block. Justice J.G. Kemei issued conservatory orders restraining further excavation, tree-felling, land clearance and construction in the disputed section, with responses directed by 17 August 2026 and a ruling on the application reserved for 16 September 2026, as reported by Capital FM, Business Today and The Standard in August 2026. The petitioners sought declarations that constitutional rights to a clean and healthy environment had been violated, the quashing of approvals, a bar on further construction until legal requirements were met, and ecological restoration. The outcome of the 16 September ruling was not verified in the searches checked for this article and is not stated here. The Green Belt Movement's advocacy manager, Job Mwangi, was reported as saying the petition was not aimed at obstructing national development but at implementation in line with the Constitution and environmental regulations. None of the reporting on that case says it seeks to stop the 5 January football match, and it must not be conflated with one.
The Mutunga and Radull exchange is now verified from X itself, checked signed in on 31 October. At 9:15 AM on 31 October, sports journalist Carol Radull (@CarolRadull) posted: "What are your thoughts on this?" with an image about activists reportedly filing a case seeking to stop the Ajax vs Bayern Munich friendly at the Raila Odinga International Stadium opening. Campus Pulse has not transcribed the image text verbatim from that check, and the image's "reportedly filing" wording is not itself proof of a filed case. At 10:12 AM the same day, former Chief Justice Willy Mutunga (@WMutunga, Chief Justice of Kenya 2011-2016) replied: "@CarolRadull State yours first!" In other words, Mutunga asked Radull to state her own thoughts first. No reply from Radull to Mutunga was found in the signed-in X search at 12:54 EAT on 31 October, and Radull's view on the fixture must still not be invented or inferred from her background. Radull's separate posts on 29 October about Bayern vs Ajax opening the stadium predate this exchange.
For context only, Radull is a veteran Kenyan sports journalist and broadcaster, Station Head at Sporty FM, who in February 2023 was appointed chair of the Sports Technical Committee of the Talanta Hela Council. That council and its committees were suspended by the High Court in 2023 in a separate case filed by Charles Mugane, and the appointments were later revoked. That 2023 history explains why Mutunga might seek her view on a Talanta matter; it does not tell Campus Pulse what her view on the Bayern-Ajax fixture is.
The wider argument is about money, priorities and who gets the stage. The government has defended a construction contract valued at KSh 45.85 billion, up from an earlier Treasury-approved figure of KSh 35 billion, citing taxes, levies and import-related charges, as reported by People Daily. Other reporting puts the initial estimate at approximately KSh 34.6 billion. A figure of KSh 48.85 billion has also appeared in reporting, without a settled explanation in the sources checked. The KSh 145 billion figure used by former Deputy President Rigathi Gachagua is not the construction contract price: Kiharu MP Ndindi Nyoro has argued the project could cost about KSh 145 billion over 15 years when interest estimated at KSh 100 billion is included, as People Daily reported. Those figures must be kept distinct. On completion, reporting differs by date and source: the Controller of Budget's monitoring report cited in The Informer put the stadium at 90.44 per cent complete, while a National Assembly committee tour on 1 October was told it was 94 to 95 per cent complete, with a target of readiness by 31 December 2026 and about three months of testing and commissioning still required after construction. The Confederation of African Football inspected the stadium in September 2026, but the final list of confirmed AFCON stadiums had not been announced in the reports checked. AFCON 2027 is scheduled for 19 June to 17 July 2027, co-hosted by Kenya, Uganda and Tanzania.
The cost of the match itself has not been disclosed by the President. People Daily reported estimates putting total expenditure at about KSh 1 billion, with Bayern reportedly commanding appearance fees ranging from KSh 433 million to KSh 863 million depending on the importance of the match and Ajax reported to charge about KSh 217 million, plus first-class flights and five-star accommodation. Those are reported estimates, not confirmed fees, and People Daily said it remained unclear whether the money would come from the Sports, Arts and Social Development Fund. Mwangi claimed each club could receive between KSh 250 million and KSh 300 million, excluding travel and logistics. An Eastleigh Voice headline referred to Sh728 million for Bayern; that headline figure was not verified against a fee agreement in the sources checked and is not relied on here as a settled amount. President Ruto said the fixture would be funded through private corporate partnerships and a self-sustaining commercial model without placing a direct burden on national tax revenue. Sports Cabinet Secretary Salim Mvurya has defended the fixture as a test of AFCON readiness — security, logistics, crowd management and fan experience — while supporters cite sports tourism and international branding. None of those positions settles what the match will actually cost, or who will pay it. Only publication of the agreements would do that, which is what the petitions and the threatened FOI request are asking for.
The other counter-voice is about Kenyan football itself. Gachagua asked why Gor Mahia or AFC Leopards had not been given the honour, or why one European side could not have faced Harambee Stars. Nairobi Senator Edwin Sifuna, at the Linda Mwananchi headquarters launch on 30 October, said he had hoped Ruto's Moscow visit would bring news of the release of more than 1,000 Kenyans allegedly recruited to fight alongside Russian forces in Ukraine, rather than news of a football match; the recruitment and detention claims were not evidenced in that reporting and the government has not confirmed them. An Education News opinion piece argued the problem was not the presence of Bayern and Ajax but making them the principal attraction at the event introducing a national facility, and proposed a Gor Mahia v AFC Leopards opener or Harambee Stars against one European club as a compromise. Fans online have been polarised: pride and excitement at a global fixture, scepticism about whether first-team squads will travel given Bayern return to Bundesliga action away at Borussia Monchengladbach only four days later, and anger that local clubs are spectators at their own stadium's opening. No vox pop or student voice is invented in this article to represent that reaction; the named, sourced voices above are the record.
What would change this story is evidence, not volume. A filed petition with a case number and pleaded grounds. A court order, granted or refused. A published fee agreement or match budget. Or Radull's reply to Mutunga in her own words. Until one of those exists, the accurate headline is the one used here: the game has not been stopped in court, the campaign to stop it is happening elsewhere, and the one court case that has actually halted Talanta-linked works is about a forest road, not a football match.
